Commonwealth Lawyers Association Raises Concerns Over Ghana’s Chief Justice Suspension

The Commonwealth Lawyers Association (CLA), has expressed concern over the suspension of Ghana’s Chief Justice, Gertrude A. E. S. Torkornoo, by President John Dramani Mahama on April 22, 2025. The CLA notes that the Ghana Bar Association (GBA) has called for the immediate revocation of the suspension, deeming it unconstitutional.

The GBA notes that the suspension violates Section 146 of Ghana’s Constitution, which states that judges can only be removed for “stated misbehavior or incompetence” or inability to perform duties due to infirmity.

The CLA emphasizes that the grounds for removing judges and the process should be clearly outlined in the legal framework, citing the Commonwealth Charter and Latimer House Principles.

The CLA stresses the importance of an independent judiciary, shielded from external pressure, and notes that suspension or removal should only occur for serious misconduct or incapacity.

In addition, the CLA urges all parties to adhere to accepted principles and standards in Administrative Law and to act reasonably and proportionally in this matter.


The CLA’s statement highlights the importance of upholding the rule of law and ensuring an independent and efficient legal profession in the Commonwealth. The organization will continue to monitor the situation and maintain contact with the GBA.
