Sen. Enoh Discontinues Suit against Usani Usani, Others
The Governorship Candidate of All Progressive Congress in Cross River State and Chairman of the Senate Committee on Finance, Sen.John John Owan Enoh has sought to discontinue the suit he had filed against Usani Usani and others before a federal high court sitting in Abuja.
Sen. Enoh had filed the suit seeking injunctive reliefs against Usani and others not to do anything to hinder the presentation of his name by the APC to INEC as winner of the Governorship primary election and Governorship candidate of the APC to contest the 2019 Cross River State Governorship election.
Inspite of the pendency of the case, the National Working Committee of APC transmitted Sen.John Owan Enoh’s name to INEC as the party’s Governorship candidate, INEC accepted and published his name as the party’s flagbearer.
Following this development, Sen.Enoh’s counsel Barr Ben Afu Leading other lawyers told the court that the case had been rendered nuggatory since it had been overtaken by events and sought to discontinue with it.
The counsel to INEC, Mrs. P.K Obi also agreed that indeed the name of Sen. Enoh has been forwarded to INEC and that INEC in compliance with the Electoral Act 2010 (As Amended) has since published his name as the Governorship candidate of APC for the forthcoming election.
Defense counsel to Usani Usani, James Ogwu Onoja aligned himself with the position of both plaintiff and counsel to INEC
